SCOPE AND PURPOSE:

The Supreme Court of the United States issued a decision in Alexander v. Sandoval, 121 S.Ct. 1511 (2001) on April 24, 2001. The Sandoval case involved a class action claim brought by non-English- speaking residents of the State of Alabama against the Director of the Alabama Department of Public Safety.

NCD conducted the following analysis of the Sandoval decision and its implications for litigation under ADA, Section 504 of the Rehabilitation Act, and the Individuals with Disabilities Education Act (IDEA).
